San Diego Same Day Marriage – California Marriage Services
Effective Date: December 19, 2025
These Terms & Conditions and Legal Disclosure (“Terms”) govern all services provided by San Diego Same Day Marriage (“Company,” “we,” “us,” or “our”). By booking, scheduling, or receiving services, you acknowledge that you have read, understood, and agreed to these Terms.
1. NATURE OF SERVICES
San Diego Same Day Marriage provides private, expedited marriage services in California, including scheduling, coordination, document workflow assistance, and lawful solemnization of marriages when all legal requirements are met.
Services may include:
- Verification of identity and eligibility
- Assistance with the confidential marriage license workflow, when eligible
- Performance of a lawful marriage ceremony by an authorized officiant
- Proper completion and routing of marriage documentation for county recording
- General informational guidance regarding proof of marriage and certified copies
San Diego Same Day Marriage is a private company and is not a government agency.
2. CALIFORNIA NOTARY & DEPUTY COMMISSIONER CLARIFICATION
In California, a Notary Public does not automatically have authority to marry couples.
San Diego Same Day Marriage operates through:
- Commissioned California Notary Publics who may also be authorized by a County Clerk/Recorder as Deputy Commissioners of Civil Marriages (or similar county-delegated roles) where applicable, and/or
- Ordained ministers/officiants authorized under California law to solemnize marriages
Any county-delegated authority is:
- County-specific
- Scope-limited
- Governed by California law and applicable county procedures
3. ELIGIBILITY REQUIREMENTS (MANDATORY)
All couples must meet California legal requirements in order to proceed.
Minimum requirements include:
- Valid, unexpired government-issued photo ID for both parties
- Both parties must be coherent enough to understand the marriage and freely consent
- Any prior marriages must be legally terminated
- Confidential marriage license eligibility applies if that license type is used
If eligibility cannot be confirmed, services may be refused, delayed, or rescheduled without liability.
4. CONSENT & CAPACITY TO MARRY
Marriage requires informed and voluntary consent.
If, in the professional judgment of the officiant or notary:
- Either party cannot demonstrate understanding
- Appears impaired, coerced, or unable to consent
- Cannot meet identification or legal requirements
The marriage service will not proceed.
This policy exists to protect all parties and preserve legal validity.
5. SERVICE OPTIONS
San Diego Same Day Marriage may offer:
- In-office same-day marriage appointments
- Mobile marriage services at a private location
Mobile services are subject to:
- Location access and safety
- Facility or venue approval
- Legal and logistical feasibility
Hospitals, care facilities, private venues, and public locations may impose additional rules or restrictions.
6. SAME-DAY WORKFLOW DISCLOSURE
Many couples complete the license and ceremony in one appointment; however:
- Same-day completion is not guaranteed
- County rules, eligibility issues, document accuracy, or consent concerns may delay or prevent completion
No guarantee is made regarding timelines outside the Company’s direct control.
7. INDEPENDENT CONTRACTORS
All officiants and notaries providing services are independent contractors, not employees.
- Contractors operate under their own commissions or credentials
- Contractors do not own, manage, or control San Diego Same Day Marriage
- No partnership, joint venture, or agency relationship is created
Assignments may be accepted or declined based on availability, legality, and professional judgment.
8. CEREMONY LOCATIONS & VENUES
Any office, chapel, or ceremony location used is independently owned and operated, unless expressly stated otherwise.
Venue rules may govern:
- Guest limits
- Photography or videography
- Access, parking, security, and timing
- Conduct, decor, and noise
Clients agree to comply with all applicable venue and location policies.
9. RECORDING & CERTIFIED COPIES
- Marriage records are filed with the appropriate county according to official procedures
- Certified copies are issued by the county, not by San Diego Same Day Marriage
- County processing timelines vary and are outside Company control
No guarantees are made regarding recording speed or certified copy issuance.
10. PROOF OF MARRIAGE
“Proof of marriage” may include:
- Completed marriage documentation
- County-issued certified copies once available
Acceptance of proof is determined by third parties such as employers, government agencies, or foreign authorities.
11. INTERNATIONAL USE & APOSTILLE
If a marriage certificate will be used outside the United States:
- Apostille or legalization may be required after certified copies are issued
- Processing timelines are controlled by government agencies
International acceptance of documents is not guaranteed.
12. NO LEGAL, IMMIGRATION, OR TAX ADVICE
- Information provided is for general informational purposes only
- No legal, immigration, tax, HR, or benefits advice is provided
- No attorney-client or consultant relationship is formed
Clients should consult licensed professionals for legal or immigration matters.
13. CLIENT RESPONSIBILITY FOR ACCURACY
Clients are solely responsible for:
- Correct spelling of names
- Accurate personal information
- Truthful disclosures regarding marital status
San Diego Same Day Marriage is not liable for errors resulting from incorrect client-provided information.
14. THIRD-PARTY SERVICES & LINKS
Third-party services or links are provided for convenience only.
- No endorsement is implied
- Third parties control their own services, policies, and timelines
15. RIGHT TO REFUSE SERVICE
San Diego Same Day Marriage reserves the right to refuse, pause, or discontinue services if:
- Legal requirements are not met
- Consent cannot be confirmed
- Safety, compliance, or professional concerns arise
16. LIMITATION OF LIABILITY
To the maximum extent permitted by law:
- Liability is limited to the amount paid for services
- The Company is not responsible for government delays, venue restrictions, shipping delays, or third-party failures
- No indirect, incidental, or consequential damages are assumed
17. GOVERNING LAW
These Terms are governed by the laws of the State of California.
18. ACCEPTANCE OF TERMS
By booking or receiving services from San Diego Same Day Marriage, you confirm that:
- You have read and understood these Terms
- You meet all eligibility requirements
- You voluntarily consent to the marriage process
